Depending on the allegations made by the victim, the State can prosecute this type of case as either a Second or Third Degree Felony.
There are significant differences between them. If the State contends that the Defendant had physical contact with the child a jury would be limited to assessing prison time only. If the State alleges that the violation was by exposure, a jury would have the option to recommend Community Supervision.
In either type of case, registration as a Sex Offender is required. However, as a Third Degree Felony, the time period is 10 years from the completion of Community Supervision or release from prison. A Second Degree Felony requires sex registration for life.
