Burglary
An individual commits Burglary if without the consent of the owner the person
enters a habitation or a building not then open to the public with intent to
commit a Felony, Theft, or Assault; or remains concealed with intent to commit
a Felony, Theft or Assault; or enters the building or habitation and commits
a Felony, Theft or Assault.
To “enter” means any part of the body or physical object connected
with the body (example: crow bar, screw driver) –
- Building ... State Jail Felony
- Habitation ... Second Degree Felony
- Habitation & Felony ... First Degree Felony
