The best way to understand Aggravated Assault is to compare it with Assault.
Assault occurs if a person intentionally, knowingly or recklessly causes bodily injury to another or threatens another with imminent bodily injury, or physically contacts another knowing it would be offensive or provocative.
An Assault is a Class A Misdemeanor. Punishment is up to 1 year in jail and/or a fine up to $4,000.00.
Aggravated Assault occurs when the offense causes serious bodily injury and/or the person uses or exhibits a deadly weapon during the Assault.
Aggravated Assault is a Second Degree Felony. The punishment range is 2 to 20 years.
If the Aggravated Assault is against a family member and the person uses a weapon and caused serious bodily injury to the victim, the offense is a First Degree Felony. The punishment range is 5 to 99 years.
