the most difficult cases to defend are Indecency With a Child and Sexual Assault.
Many tunes these cases bring unwanted media attention to the suspect causing
public shame and alienation. Even without television and newspaper coverage,
the nature of these offenses result in loss of job, and estrangement from family
and friends. The lucky defendant has a family and employer that does not abandon

In Texas, particularly in Harris County, the prosecution of Indecency and Sexual
Assault cases are aggressively pursued. The District Attorney has a specialized
unit that focuses on cases involving the alleged sexual exploitation of children.
On September 1, 2007 there was a significant change in the law affecting probation
for cases involving sexual assault, indecency with a child (contact) and aggravated
sexual assault. If found guilty by a jury, they can no longer recommend community
supervision if the victim was younger than 14 at the tune of the incident.
Prison is the only option available, even if the Defendant has a clean record.
However, not all hope has been lost. Even under the new guidelines
it is still possible to obtain probation by going directly to the judge. This
would require that the Defendant plead guilty to the offense and the judge
may place the Defendant on Deferred Adjudication (regardless of the victim's
age) if the court determines it is in the best interest of the victim.
