A DISCUSSION ON SEXUAL ASSAULT OF A CHILD
Possibly the most difficult cases to defend are Indecency With a Child and Sexual Assault. Many times these cases bring unwanted media attention to the suspect causing public shame and alienation. Even without television and newspaper coverage, the nature of these offenses result in loss of job, and estrangement from family and friends. The lucky defendant has a family and employer that does not abandon him or her in this period of agonizing self doubt and fear.
In Texas, particularly in Harris County, the prosecution of Indecency and Sexual Assault cases are aggressively pursued. The District Attorney has a specialized unit that focuses on cases involving the alleged sexual exploitation of children.
On September 1, 2007 there was a significant change in the law affecting probation for cases involving sexual assault, indecency with a child (contact) and aggravated sexual assault. If found guilty by a jury, they can no longer recommend community supervision if the victim was younger than 14 at the tune of the incident. Prison is the only option available, even if the Defendant has a clean record.
However, not all hope has been lost. Even under the new guidelines it is still possible to obtain probation by going directly to the judge. This would require that the Defendant plead guilty to the offense and the judge may place the Defendant on Deferred Adjudication (regardless of the victim's age) if the court determines it is in the best interest of the victim.

The minimum term of imprisonment for this offense is incarceration for twenty-five (25) years if:
1. The victim of the offense was younger than six (6) years of age at the time the offense was committed; or
2. The victim of the offense was younger than fourteen (14) years of age at the time of the offense and the Defendant caused serious bodily injury; or placed the victim in fear of death, serious bodily injury or kidnapping; or by acts or words in the presence of the victim threatened to cause death, serious bodily injury or kidnapping of another person; or uses or exhibits a deadly weapon, or administers a chemical agent to facilitate the crime.
